Disciplinary action is easier to justify when you have a clear policy that forbids this type of conduct, instead of disciplining an employee for conduct they didn’t realise was prohibited.

Currently most companies will have a Public Relations strategy in place. What about the legal implications? MySocialPolicy and BalndsLaw can provide 24×7 access to legal assistance if your company encounters a social media crisis. Employees don’t realise they owe you a duty of loyalty when they’re off the clock. The lines between public and private, and personal and professional are blurred in online social networks. One small tweet or post to Facebook may be totally detrimental to your brand and not even have your name on it. How does that work?

Smart companies like ‘Apple’ tackle this issue by explaining that once staff identify themselves as an Apple employee or are known to be one, they are then connected to their co-workers, leaders and even Apple’s customers. Therefore, all staff of Apple must ensure that content associated with the employee is consistent with Apple policies.

Employers need guidelines, too. If you are vetting candidates on Facebook, how far do you go? Are you only looking at what is publicly available, or are you asking applicants and employees for passwords or URLs to their private Facebook page? If you are investigating current employees on the Internet, do you believe you have the authority to look at their private websites? Must you get their permission?

By holding staff accountable to their online actions you in turn as an employer need to adjhere to guidelines so your staff know the overall limits and they too feel protected.

In such a volatile and public arena to conduct business and mange brands, you want to know someone has ‘got your back’! With the Total Social Media Risk Management Package, you are rest assured the specialists at BlandsLaw will be there when the tweet hits the fan.
